Question : We are EPC contractor undertaking projects in south african country. We are exporting many equipment from Inida under GR Waiver approval on returnable or non returnable basis. For non returnable goods, we need to close GR Waiver from concern bank. Any time frame from customs or RBI to close non returnable GR Waivers. If not, in what period exporter shall close GR Waiver case with concern bank.

Question : Dear Sir. We would like to import 3-crawler crane for execution of project from china for our Nepal Project Site (Ayoki taken project on contract basis ). Nepal is land lock country and hence not possible to import from china to Nepal. We are planning to import these crane to Mundra port India and export by road to Nepal site. Our query-1) Can we import these crane to india and re export by road to Nepal. 2) We would like to clear these crane under Duty script license at Mundra port and export to Nepal. 3)IGST paid to customs is refundable if these crane exported to Nepal.

Question : Dear Sir, We would like to know whether as a merchant importer/exporter we can import haz chemical class 8 II store the same in bonded warehouse & export either as FCL or LCL depending on export order , please advice under customs act section we can do the same. Documents as merchant importer exporter we need avail before import export activity. We would like to understand what are the pre & post conditions for the same under customs rule. Question : I have attended workshop yesterday. There are some ambiguities in customs procedure as discussed below. Tata International Ltd is a merchant exporter of Metaliks products like Pig Iron, Sponge Iron and Engineering products like Rolls for Rolling Mills to Indian Sub-Continent, South East Asian countries Far East countries, Middle East and East African countries etc. Tata International is a pure trading organization where we procure material from Tata & Non-Tata suppliers located in Kharagpur & Durgapur in WB, Chandil & Chaibasa in Jharkhand, Barbil in Orissa, Pune in Maharashtra etc. We export - Pig Iron & Sponge Iron to Benapole, Bangladesh by Road through Petrapole-Benapole border - Pig Iron & Sponge Iron to Chittagong, Bangladesh by Containers through Kolkata/Haldia port - Sponge Iron to ICD Birgunj & Nautanwa, Nepal by BCN rake - Pig Iron to Sri Lanka, Pakistan, Indonesia, Thailand, Taiwan, Malaysia, Singapore, Japan, S Korea etc. by containers through Kolkata, Haldia, Vizag, Nhava Sheva port etc. As per current practice we are transporting empty containers for stuffing, local sealing at factory premises and then stuffed containers are appraised by customs & liner sealing is done inside dock premises before cargo readiness on board. We are also bringing Sponge Iron from Jharkhand, Orissa region to our private warehouse located @ Dankunia, Kharagpur & Khidirpur for container stuffing and then stuffed containers are appraised & local sealing is done inside dock premises before cargo readiness on board. Kindly guide us the following- 01. What would be revised procedure from 1st November 2017 onwards.. 02. From where we will procure electronic seals and where we should apply it (In factory/CFS/port) 03. Whether we can apply to customs by showing our agreement with respective suppliers for self-sealing of containers at factory premises Kindly confirm the same

Question : Dear Sir I am working in a Freight Forwarding Company in New Delhi. i am doing business from CHA Base Companies. CHA Given Container;s Booking 14x40HQ ... As per business terms , 30 Days credit agreed with PDC. so ploblem come out .13 Containers has been Delivered at destination but we have not received freight payment from CHA Companies . All given cheques has been Bounced. My company immidiatly acd message sent to shipping line for HOLD delivery for stop 14th container''s delivery. Reason given to shipping line we have not received freight payment from customer. now actual exporter going to take bill of lading direcct from shipping line.Maersk . instead of our company m/s starship lines pvt ltd. our 13x40 hq container payment hold on from CHA Companies. Now Actual Shipper PUT FIR police station for his Bill of lading. Container alreaady reached at destination. PLZ suggest me ,for next duty or my company M/s Starship Lines Pvt Ltd. looking up coming duty for us. Question : WE ARE A CUSTOM HOUSE AGENT AND HAVE A SHIPMENT OF MADEUPS (COTTON CUSHION COVER) THROUGH MERCHANT EXPORTER.THE MERCHANT EXPORTER HAVE PAID A GST TO SUPPLIER AT THE TIME OF PURCHASE THE GOODS FROM A LOCAL MARKET. NOW MERCHANT EXPORTER IS GOING TO EXPORT THE GOODS TO AUSTRIA . THEY DOESNT HAVE A LUT OR BOND AND THEY ASKING TO CLAIM THE GST WHICH IS PAID TO LOCAL SUPPLIER. SIR, CAN WE FILL THIS LOCAL GST IN S.BILL IN IGST PAYMENT STATUS OR I SUGGEST TO PARTY TO PAY THE IGST FIRST ON EXPORT INVOICE VALUE AT THE RATE OF 12% AS PER IMPORT TARIFF AND CREATE A TAX INVOICE. IS THIS CORRECT PROCEDURE , PL ADVICE ON PRIORITY BASIS BECAUSE THE SHIPMENT HOLD UP FOR PROCESSING THE S.BILL. YOUR VALUABLE GUADANCE WILL BE HIGHLY APPRECIATE TO ME.
